PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.


Ordering and Site Security

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated below.

Defective Order

We guarantee that all merchandise received will be complete and free of all damage and defects. If your items are damaged, defective or incomplete, please email East Coast Music and contact the manufacturer within 15 days after delivery. The customer agrees to contact the manufacturer's Support Team and fully cooperate to troubleshoot, identify, repair or replace the defective part(s) or product as requested by the Support Team. The manufacturer's Tech Support can help to get the product up and running without needing to return. In the event that a product is found to be defective, Tech Support can often arrange to exchange parts or products directly with you. If Tech Support approves East Coast Music to ship you a replacement order, please email us and provide the Tech Support Case Number and supporting emails and documentation. We will email you directions to return the defective order and upon its receipt and inspection we will immediately ship you a replacement order. Defective products must be reported within 15 days after delivery. A defective product can only be exchanged for a replacement product of the same title and platform only. Refunds cannot be issued for defective products. Outside of the 15 days after delivery, defective products will be subject only to the manufacturer's warranty.


Return & Exchange Policy

East Coast Music wants to make sure you are satisfied with your purchase. Please email us any requests (including return and exchange requests) questions, concerns or problems . Our policies, terms and conditions are subject to change, so please check our statements regularly.

Please note that we cannot cancel or change orders once an order has been shipped or has been processed, is in the Shipping queue and is too far into the process to prevent shipment. When an order is submitted, our Shipping Department processes the order quickly and shipment enter the Shipping Queue in the order that they are received. If your order has not been shipped and the shipment can be stop then you can cancel or change your order. For orders with multiple items and with one or more items not in stock the customer agrees that East Coast Music may cancel the items and ship the remaining items of the order. The customer further agrees that East Coast Music may choose to have distributors, manufacturers and other companies ship the items in the order directly to the customer for various reasons.

Please be advised that All Sales Are Final; Returns or Exchanges Are Not Allowed.The customer is strongly encouraged to be careful when placing an order and to be sure that the product and shipping method that they have selected are the ones they want. Customers should solely use the product description as published on our website for purposes of determining whether the product is the correct item to purchase. East Coast Music is an authorized dealer for many publishers and manufacturers and must comply with contractual and licensing terms and conditions, copyright laws and other obligations. Please note that the vast majority of our items cannot be resold or returned to the publishers or manufacturers for refund purposes when they are returned to East Coast Music.

East Coast Music is an authorized dealer for many publishers and manufacturers and must comply with contractual and licensing terms and conditions, copyright laws and other obligations. Therefore, returns of copyright protected products including sheet music and songbooks, cannot be accepted when the shipping box or envelope is opened and no longer sealed indicating that the customer may have used or copied the products. Please note that the vast majority of these opened products cannot be resold or returned to the publishers or manufacturers for refund purposes when they are returned to East Coast Music.
If the customer shipment is returned to East Coast Music or its distributors due to insufficient or inaccurate address, then East Coast Music may charge the customer for the Shipping and Handling costs.

Copyright Sheet Music and Software Programs

Under the U.S. Copyright Law, copyright owners have the exclusive right to print, publish, copy, and sell their protected works. Printed and electronic sheet music and songbooks you use reaches you as a result of the collaboration of the songwriter, composer or arranger who devotes her or his time and creative effort; the publisher who invests time and money; and your local music retailer who supplies your musical needs. Software programs also employ a similar collaborative effort to get their products to you. All sheet music, songbooks, software programs, printed and electronic material and products East Coast Music sells is copyright protected. As a result and to comply with copyright laws and licensing agreements and protect the rights of copyright owners including songwriters, composers or arrangers, we are prohibited from accepting the return of delivered/opened printed and electronic sheet music, songbooks and software programs. These products can be easily copied and this is prohibited per copyright laws.

 You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the site solely for your own non-commercial use, or to place an order with products. Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of this site is strictly prohibited, unless authorized by The entire content included in this site, including but not limited to text, graphics or code is copyrighted as a collective work under the United States and other copyright laws, and is the property of East Coast Music. Shipping

East Coast Music guarantees Same Day Shipping for orders with UPS 1, 2 or 3-day delivery (not USPS) and when submitted by 11AM EST. We recommended that customers select UPS 1, 2 or 3-days shipping for urgent or time critical orders. For orders with other shipping methods: additional processinjavascript:void(0);g time may be required (normally 1-3 business days), orders are processed and shipped in the order received and processing backlogs and delays may be encountered (especially during peak rush periods such as holidays and start of the school semester). The shipping days noted on each shipping method are estimated business, M-F days, and excludes processing time. USPS Media Mail can only be used for printed or electronic media, sheet music or software.

All trademarks, service marks and trade names of East Coast Music. used in the site are trademarks or registered trademarks of East Coast Music


Backorder or Preorders

The vast majority of all backorders are delivered in a timely manner. However, there are always a few backorders which become troublesome and, in some case, cannot be delivered (such as later discontinued by the publisher). We wish to reassure customers that East Coast Music will strive to get backorders in a timely manner but if unable to do so we will always issue a full refund. Hopefully, this will help reduce customer anxiety and also bad customer reviews when we encounter problems with the delivery of backorders.

Backordering or preordering is the process of allowing customers to order products even when there is no physical stock on hand to immediately ship an order.

Customers must agree and accept the following conditions pertaining to Backorders
  • When a product is out of stock, backordering the product provides an opportunity to be among the first ones to receive the product when it becomes available. The publisher or manufacturer maintains a cue or list of backorders for each backordered product. When the backordered product becomes available the backorders are automatically shipped using the cue or list and based on the date the backorder. Also, being on the list helps insure your backorder is shipped before the stock can depleted again.
  • The vast majority of out of stock products are printed and shipped within the estimated 1-3 weeks’ timeframe. However, there are always some products that take much longer and some products that may later be discontinued by the publisher.
  • • Customers are charged at the time of order placement and in advance of shipping for the backorders.
  • Publishers automatically ship the products when they are back in stock.
  • The publishers normally do not notify East Coast Music when they ship a backorder and they do not notify us when a backorder is not shipped. It is best to email us on a 3-4 weeks basis and request the status of your backorder.
  • Customers are free to cancel a backorder at any time, receive a full refund and then order the backordered publications elsewhere. Please note that that if we are out of stock on a product then most likely everyone else is also out of stock.
  • Customers can trust East Coast Music and if the backorder is not delivered a full refund will be issued.

Backorder service is available to large volume customers that have historically order a large number of products and are familiar with backorder practices such as symphonies, choral groups, school, churches and etc. Backorder service is not available to individual customers. We believe that the backorder process may be too difficult for individual customers to fully comprehend due to a general lack experience with backorders and it also may involve a trust issue.

Individual customers can request backorder service on exception by emailing East Coast Music and acknowledging acceptance of the above conditions.

For over 15 years these large volume customers have used our backorder service and have learned to understand and appreciate this service and to trust East Coast Music. Customers want to be first on the publisher’s cue or list to receive the product when they are printed and before the product is out of stock again. These customers know that the vast majority of out of stock products are printed and shipped by the publisher within the estimated 1-3 weeks’ timeframe but they also know that there are always some products that take much longer and some products that may later be discontinued by the publisher. Large volume customers also understand that East Coast Music and other companies must charge costs in advance of shipping for the backorders and that publishers automatically ship the products when they are back in stock and publishers usually do not notify us or other companies when they ship the backorder. Also, customers know that they are free to cancel the backorder at any time, receive a full refund and then order the backordered publications elsewhere (but they also know that if we are out of stock most likely everyone else is also out of stock). Finally, Large Volume Customers have learned to trust that East Coast Music and if the backorder is not delivered they will receive a full refund.

Warranty Disclaimer

This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, East Coast Music. East Coast Music. does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. East Coast Music. does not make any warranties or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.


Limitation of Liability

 East Coast Music. shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if East Coast Music. has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.


Typographical Errors

In the event that a product is mistakenly listed at an incorrect price, East Coast Music reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, East Coast Music shall issue a credit to your credit card.


Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by East Coast Music. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

East Coast Music may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to East Coast Music.


Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of Wyoming, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of East Coast Music. products) shall be in the state or federal courts located in Wyoming. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of East Coast Music. products) must be commenced within one (1) year after the claim or cause of action arises. East Coast Music's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a East Coast Music. or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
